The School District has been identified as a “Potentially Responsible Party” (PRP) in a suit being filed by the United States Environmental Protection Agency (USEPA) and the Louisiana Department of Environmental Quality (LDEQ). This suit stems from hazardous waste that was collected from various sites around the nation and transported to Amelia, Louisiana for proper disposal.
According to Hazardous Waste Reports included in the school districts packet, waste was removed from the maintenance compound and received by the Marine Shale Processors Site in May of 1989. While removal of the hazardous waste was performed in compliance with federal and state statutes, the district is not immune from this type of potential litigation.
I have had Mr. Green review the entire packet that I received and offer his legal opinion concerning the De Minims Settlement of $2,000 that is being offered to the school district. Mr. Green’s opinion is that it is in the school district’s best interest to accept the De Minims Settlement and bring this issue to a close.
